Event Participation Assumption of Risk and Liability Waiver
Thank you for signing up as a (“Participant”) of an Oregon Pride in Business (“ORPIB”) event. Whether virtual or in person, we strive to make every event as safe as possible. That said, there are risks to participants of all kinds of events, some of which we cannot predict, avoid, or control even with our best efforts. As a result, we require that all event participants upon registering for an event attest that they have read, understand, and agree to the terms of this “Event Participation Assumption of Risk and Liability Waiver.”
By signing up for the event and checking off on/agreeing to these terms, you are agreeing to the following:
- I have knowingly and voluntarily chosen to participate in this event.
- I hereby assume any and all of the risks (known or unknown) of participating in the ORPIB event that I am participating in.
- I acknowledge that during an event of any type, participants may be photographed and/or videoed.
- I hereby acknowledge that ORPIB does not carry or maintain health, medical, or disability event insurance coverage beyond general liability policy for events. I consent to receive medical treatment, which may be deemed advisable in the event of injury, accident and/or illness (physical, mental, or both) before, during, or after this event, NOT AT THE COST OF ORPIB.
- I acknowledge that COVID-19 is still prominent and affecting our community locally and beyond. I acknowledge that by attending an ORPIB event or program in person, I am voluntarily and knowingly taking a health risk. I acknowledge that ORPIB cannot guarantee that I or anyone I maintain contact with will not become infected with COVID-19. You are agree to the following:
- You have been fully vaccinated and follow Center for Disease Control’s guidelines regarding future booster shots.
- You will not appear for an in-person event if you have or are experiencing fever, fatigue, difficulty breathing, or dry cough or exhibiting any other symptoms relating to Covid-19 or any communicable disease within the 14 days preceding the event date that you have signed up for.
- You have not been, nor has any member of your household, diagnosed to be infected with Covid-19 virus within the 30 days preceding date the event begins.
6. I acknowledge that some events may be virtual or hybrid (ie. in person with an online streaming component) whether intended or for last minute in person event challenges. I acknowledge the following:
- ORPIB’s default is to record all online events. Participation requires that participants at the start of the call agree to the platform’s request to accept recording.
- Any information shared during an online event is deemed to no longer be held confidential if it was deemed to be confidential prior to the participant’s charing. Information, sound or video clips of the event, or the event in whole may be disseminated by a participant to the public. ORPIB has no control over where this information or these media content captures end up as ORPIB does not have control over third party actions.
- ORPIB has the right to mute online event participants or ask them to leave should they not follow reasonable participation rules and/or be disrespectful or threatening to ORPIB staff, volunteers, guests, or other participants.
- ORPIB is a facilitator of the event and not a publisher of the information in terms of “publisher liability. Additionally, ORPIB is not responsible and will not be held liable for any information shared or actions taken with or among participants post event.
- HEREBY WAIVE, RELEASE, AND DISCHARGE ORPIB from any and all liability, including but not limited to, liability arising from the negligence or fault of ORPIB, ORPIB’s employees, contractors, or agents from personal injury, property damage, property misplacement/loss/theft, death, disability, or actions of any kind.
7. In case of a dispute, ORPIB and the Participant will attempt to resolve any controversy or dispute in connection with this agreement on an amicable basis, through their prompt good faith discussions or non-binding mediation. More specifically, prior to either party bringing a claim or cause of action in court or at a binding arbitration process, parties will give best faith efforts to resolving the matter(s) with a mutually chosen, third-party neutral mediator.
8. This Agreement is made in and will be governed by and construed in accordance with the laws of the State of Oregon, without reference to principles of conflict of laws or choice of laws.
9. All provisions of the Agreement are severable. A legal or judicial determination that any particular provision or term is illegal or unenforceable shall have no effect upon the remaining terms of the Agreement.
10. You represent that you are at least eighteen (18) years old and fully competent to give your consent and that you have been sufficiently informed of the risks involved. You agree and are giving your voluntary consent in signing this ASSUMPTION OF RISK, RELEASE, AND WAIVER OF LIABILITY as your own free act and deed with full intention to be bound by the same, and free from any inducement or representation.
11. This Agreement contains the entire understanding of the parties relating to the subject matter, and shall not be altered, modified, amended, waived or supplemented in any manner whatsoever except by a written agreement signed by both parties hereto or their duly authorized representatives. This Agreement may be executed, made and delivered electronically.
